Dear Cathy & Kelly,

TRUTH FEARS NO QUESTIONS,so goes an anonymous saying. Well from all the headline news about the major U.S. banks, one keeps wondering whether the word Truth exists in the bank’s dictionary or not!

Candidly speaking, reading about how Banks Stonewalled Probe Of Foreclosure Practices as claimed by the U.S. Department of Housing and Urban Development, we are sure to be discarded. Who are we? Many of our fellow American homeowners who are also engaged in the drawn out episode of obtaining the much needed modification will find it appalling that Bank of America just does not care about its Customers.The HUD report is unequivocally clear about how Bank of America “Significantly Hindered” the investigations. Let’s together take a quick look at the following:

1. Failing to respond to borrowers’ inquiries.

2. Providing false or misleading information to consumers while initiating
foreclosures during the loan modification application process.

3. Falsely advising borrowers that they must be at least 60 days delinquent
in loan payments to quality for a loan modification.

4. Misleading borrowers by representing that loan modification applications
will be handled promptly when Banks regularly fail to act on loan modifications

in a timely manner.

5. Failing to assign adequate staff resources with sufficient training to handle
the demand from distressed homeowners.

It is better to set aside the oft-repeated excuse of the “Investor.” A written statement from Michael J. Meehan of Blank Rome, LLP., explicitly states that, “the current owner of the note is Wells Fargo Bank, N.A.” Hence, it is pointless to throw a monkey wrench to divert the attention from “Home Loan Modification” that will help lower the payments not inflate them by close to 40% in our case.

Yesterday’s conversation with one of you, that is, Kelly Thompson, the emphasis was placed on “The Lodhias” engaging “A Legal Counsel.” Yes, we do have a legal representation, but Bank of America chose not to respond to Daliah Brill, PC. Ms. Daliah Brill was copied in all of our correspondence with Bank of America since last summer. For the matter of record, neither Shuping, Morse, & Ross, LLP., nor Blank Rome, LLP., got in touch with her. There was only one phone call she received from Mr. Bhagiya Goonetilleke (Buggy), a negotiator from Bank of America on July 11, 2011. 

For the past three years in a row, we “The Lodhias” have been at the forefront writing and re-writing the same old appeals for “Home Loan Modification” to no avail. Care to look at Bank of America’s national advertisements? Then click on the following links:

Ladies, when it comes to “Loan No: 872195598” none of the above applied. Mr. Bhagiya Goonetilleke (Buggy) who (until the last minute) kept telling us that the modification of the loan will be based upon 31% of the gross income. This was nothing but “A Downright Lie.” The truth of the matter is, we “The Lodhias” only have in our possession “Written Documentation,” whereas, Bank of America has nothing to show for in writing. Not to mention, the scary part is that your phone recording states as follows:

Your call may be monitored or recorded for quality assurance.

May be” this is another trick up the sleeves as when push comes to shove to extract any evidence, all of the recorded conversations could well, disappear in the thin air. THINK-a-little, ladies.

Most importantly, try not to rant and rave about the “Mysterious Investor.” If there was one, then why is there such a hard time in revealing the name? Note that all of our genuine concerns are displayed in this blog: THINK-a-little, MR. MOYNIHAN. We “The Lodhias” thought a little and are absolutely baffled pondering over the following questions:

1. Why would any investor demand U.S. $ 25,000 and then shy away from
collecting the funds?

2. Why would Bank of America refuse to accept U.S. $ 43,000 to adjust the
past due payments given that the family members and friends of the distressed

American homeowner are willing to help?

3. Why is there penalty and late charges? Is that our fault or an outright sloppy
mishandling of the “Home Loan
Modification” application by Bank of America?

4. Where is Bryan Cortez, an account executive of Bank of America who met
with us at the “Customer Outreach
Event” on April 9, 2011? Certainly, Bank of
America must have in its possession all that was discussed and agreed
upon between
Mr. Cortez and “The Lodhias.

5. Can you both be able to shed light on the attached “Assignment” copy along with
the “Limited Power of
Attorney” documents?

All in all, we “The Lodhias” have “A Legal Counsel.” It will be better to get in touch with Daliah Brill. We are mentally tired and worn out. We have suffered enough, and as such, we want everyone at Bank of America to stop making us run around in circles. If there is a sincere desire to resolve our pending case of a “Home Loan Modification,” then let us sit down in “A Face-To-Face Meeting” at the Bank of America branch office, located on 5500 Peachtree Parkway – Norcross, Georgia 30092. Monroe Austin, the Vice President will surely vouch for “The Lodhia’s” mighty struggle for the past three years.

By the way, one more thing, we will see to it that someone from the media will be present during our negotiations. If Bank of America spends a fortune in advertising about “Assisting Customers,” then why not display the earnest willingness to do so? We have done our part and now it is Bank of America’s turn.

Have been speaking with BofA customer service personnel for last few days and was informed I had been assigned a Loan Negotiator (Bryan Cortez, Boss is Humberto Lopez) and Loan Advocate (Greg Schmidt). Said this was great….then after two days just spoke with another negotiator (Ann Nguyen) due to my assigned one being out of the office for last couple days. After she asked for some “missing documents” I indicated that all the people I had spoke to so far indicated there was nothing missing from my file? I said “which file are looking at”? At this point she stated it was the NACA file as opposed to what I thought was the HAMP file. To back-up I had been working on a HAMP mod for the last 24 months and decided a month ago to check into the NACA process. My wife and I meet with the NACA rep. on 1-15-11 and gave them our information thinking we could have two sticks in the fire for hopefully a faster result.

Just was assigned a BofA negotiator by the name of Brian Cortez. Has anyone heard of him before and have any experience with him? I am fairly new here, is there an average time period between being assigned to negotiator and this person making first contact?
